Court won’t hear Reading’s appeal over rejected dog law

Reading, PA – The state Supreme Court has [...]refused to hear the city’s appeal of an earlier ruling that threw out Reading’s 10-year-old aggressive breed ordinance, effectively killing the ordinance.

The measure had imposed severe restrictions on dog breeds that bit too many people – an action not taken since 2003. In February, the Commonwealth Court ruled it violated state law banning municipalities from prohibiting or otherwise limiting a specific breed of dog.[...]

The stricken ordinance

The courts have thrown out Reading’s 10-year-old aggressive dog breed ordinance. Whenever a breed was deemed responsible for too many bites in a given year, the ordinance put these rules into effect for breed owners the following year:

•Owners had to get a $500 permit to keep a non-neutered male of the breed.

•Owners had to post signs at their homes alerting neighbors of their dogs’ presence and erect tall fences to keep their dogs from leaving their yards.

•When in public, their dogs had to be muzzled and kept on short chain leashes.

MOSES LAKE – One Moses Lake man is working to be in compliance with the hazardous dog ordinance and asked the Moses Lake City Council for help concerning the requirements.

LOWELL — An hour of passionate lobbying from animal advocates convinced the City Council to delay a vote on a proposed pit-bull ordinance last night.

[...] Emanuel Maciel, the president of the Animal Control Officers of Massachusetts and Animal Control Officer for the city of New Bedford said breed-specific laws are too difficult to enforce because there are so many mixed breeds.

“In New Bedford the ordinance does not work,” he said. “You take the dog to the vet and the vet says it is a boxer mix, then what do you do?”

Councilor Rita Mercier admitted that she had been leaning toward approving the ordinance, but the evening’s testimony swayed her.

The Council voted unanimously to delay the vote in order to take representatives from the MSPCA, Humane Society, Lowell Unleashed and others up on their offer to work with the city to formulate an ordinance that will work best for all residents.

Public hearing about proposed BSL (”pit bull ordinance”) will be held on Jan. 13 at 6:30 PM. Apparently the council will vote on the ordinance immediately after the hearing.

Critics say vicious dog law already on books is enough

LOWELL [...] Following a public hearing Tuesday, the council is expected to vote on an ordinance mirroring a Boston law requiring pit bulls be leashed and muzzled when off their owner’s property. Haverhill has an ordinance that requires pit bulls be muzzled.[...]

The pit bull ordinance would require owners to register and license and spay or neuter dogs. Owners would have to leash and muzzle pit bulls when off their property. The ordinance would restrict owners to two pit bulls per household, with the exception of a litter of puppies and would require owners to post signs saying, “Beware of Pit Bull.”

OMAHA (KPTM)- The new year brings new laws and Omaha pit bull owners must now obey the final piece of the city’s dangerous dog ordinance that goes into effect January 1, 2009.

[...] The Humane Society says so far 27 owners have complied with all the stipulations to opt out of the muzzle requirement so far.[...]
