Elgin, IL: BSL likely to be proposed again

Councilman Prigge renews his crusade against all “pit bulls” and their owners due to the irresponsibility of a few. Upon passage of a non-breed-specific ordinance back in March, Prigge stated he would reintroduce BSL if another “pit bull” attacked. Was there going to be another “pit bull” bite in Elgin? Of course. There were probably quite a few non-”pit bull” attacks since then as well, but that doesn’t seem to concern Prigge.

Will Elgin leaders reconsider stricter laws for pit bulls and their owners?

That’s one question that has been raised after a weekend incident in which officers shot and killed two loose pit bull dogs after one bit a 9-year-old boy in front of about 100 people at the fountain at Festival Park….

In March, Elgin councilmen enacted a new law classifying any dog that attacks another animal or human as “dangerous,” triggering a number of added regulations for the owner of such an animal.

Campaign to End BSL: Operation Denver

The Goal

The objective of Operation Denver is to collect one mile of postcards that will be delivered directly to the Mile High City’s mayor, John W. Hickenlooper. Though the state prohibits municipalities from passing BSL, Denver’s breed ban was sort of grandfathered in, so we’re targeting the city itself.

The Postcards

To meet USPS’ regulations for the cheapest postcard, they have to be 4 x 6″ which means we need to collect 10,560 postcards for them to stretch one mile, end to end! And I know we can do it!

I created a simple template in Microsoft Word with text boxes aligned to meet the post office’s regulations. These postcards can be customized any way you’d like! Get creative! Use images, clip art, text boxes, fonts and colors. If you prefer to use another program (or even make one by hand!), please feel free as long as the measurements adhere to the regulations.

The council has decided against an ordinance regulating pit bulls in Lodi.

At a public meeting on May 17 any ordinance involving dogs or pit bulls was missing from the agenda. However, a member of the public addressed the council, stating her opposition to the proposed ordinance….

Mayor Bruce Masopust told Sheldon that the council considered the ordinance for a while but ultimately decided against it.

Ohio HB 79 passes House, moves to Senate

Ohio House Bill 79 made it through the Ohio House Of Representatives today! It was added on to HB55 and went up for a full vote on the floor. It is now moving to the Senate. I will post updates as soon as I know who we need to send letters to. As a reminder, HB79 would remove the term “pitbull” from the Ohio Revised Code’s definition of vicious dog. Ohio is the only state that has statewide BDL.

Summary: Rui Branco’s family dog was seized by the city of Brampton for being a ‘pitbull,’ and held over three months. Eventually, the dog was returned when an independent assessment said she was not a ‘pitbull.’  Branco has since become the campaign manager for Bruce Haines, opposing the current mayor, Susan Fennell. Branco accuses, “Susan Fennell has refused to independently investigate this matter … all the while wasting tens of thousands of the taxpayers’ dollars to facilitate a cover-up.”

RE: Dog Breed Restrictions

Dear Residents of Lincoln Military Housing:

As you are probably aware, the Navy Housing Instruction, numerous other Public Private Ventures and many apartment communities have stopped allowing certain breeds of dogs. Such restrictions will be phased into the Lincoln portfolio here in the Hampton Roads region as well. While this represents a change in policy, we hope you will find that we have taken great strides to ensure that this does not have a negative impact on our current residents.

Please see the following list of soon to be restricted breeds:

Chows, Doberman Pinschers, Presa Canarios, Pit Bulls (American Pit Bull Terrier, American Staffordshire Terrier, Staffordshire Bull Terrier), Rottweilers, any Wolf Hybrid, or any mix of the aforementioned breeds.

Current Residents: any of the above dogs that are living in Lincoln housing (and are properly registered with the local municipality and the Lincoln housing office) on or before June 15, 2010, will be allowed to stay. After June 15, 2010, current residents will no longer be allowed to bring new dogs of the above breeds into housing. That includes new dog purchases/adoptions as well as litters of existing dogs.

New Residents: as of May 1, 2010, Lincoln ceased to sign new leases with any family possessing a dog from the restricted breed list. Any resident that moved in after May 1, 2010 will not be allowed to possess dogs from the restricted breed list.

Current Residents Transferring from one Lincoln home to another: will be handled on a case by case basis. Factors that will be taken into consideration will be (i) whether the resident is choosing to move or they are moving due to circumstances beyond their control, (ii) history of resident and pet compliance with policies, (iii) history (if any) of complaints against the dog(s).

Note: these restrictions to [sic] not apply to doctor ordered service animals.

Pointe Coupee Parish, LA: BSL discussed (10 breeds affected)

Pointe Coupee Parish appears to be moving forward with BSL that would affect owners of German Shepherds, Dobermans, Rottweilers, Boxers, Akitas, Chows, and four types of “pit bulls.” They have gone so far as to ask the major city inside the parish (New Roads) to also pass the breed-specific ordinance.

NEW ROADS — [...] Under an Animal Control Committee proposal, German shepherds, Doberman pinschers, Rottweilers, boxers, Akitas, chow chows and pit bulls would be subject to the ordinance.

The Police Jury decided to ask New Roads to adopt a similar animal-control ordinance because the proposed parish ordinance would not supersede city, town and village laws.

Dog enthusiasts opposed possible breed-specific regulations focusing on pitbulls at an Auburn City Council meeting Monday….

The proposed amendments would enforce the spay and neuter of … dogs resembling the pitbull breed, according to city documents.

The amendments, which were presented in a first reading only, would also enforce no more than two dogs of all breeds be kept in each residential home. Spay and neuter regulations would only apply to pitbulls.

Garland, TX: Fencing Requirement for Pit Bull Dogs

Texas state law (Texas Health & Safety Code §822.047) prohibits breed-specific ordinances. Garland, TX, has recently instituted breed-specific fencing requirements for “pit bulls.” However, it does not appear to be officially codified in the city’s ordinances; at the moment, they are calling this an “ordinance-based directive.”

Garland is attempting to “sweeten the deal”–perhaps to quiet objections–by saying that because of this ordinance, they can now start adopting out “pit bulls” from their animal shelter, something which they refused to do in the past. Yet, finding good homes for pit bulls is done elsewhere in Texas on a regular basis without the need for breed-specific ordinances, and without the need to discriminate against all “pit bull” owners in the city.

If secure fences are important for “pit bull” ownership, it is because they are important for dog ownership in general; all dog owners should be held to the same requirements and should be expected to provide the same standards of care for their dogs. There is no legitimate reason why “pit bull” owners should be required to have secure fences while owners of other breeds or types of dogs are not required to have the same.

Please note it is unclear what, if anything, city council members know about this directive. Please direct primary correspondence to the creators of this directive: Jason Chessher (Deputy Director of Health) and Diana Oats (Animal Services Manager). Correspondence to city council should be made with the consideration that council members may not be well-informed about the directive.

The Animal Services Advisory Committee has been working on this directive. Next public meeting of the committee: 12:30 PM on Friday, July 16, 2010 in the City Council Work Session Room at City Hall, 200 N. 5th St.

Garland, Texas – May 24, 2010 — Garland Animal Services is preparing to enforce new fencing requirements for pit bull dogs or pit bull crossbreeds. Pit bull dogs or crossbreeds thereof have been responsible for the most dog bites since statistics have been kept (2004). Additionally, 27% of the dogs caught while running at large are pit bull dogs. In response to this growing public safety problem, Garland Animal Services has developed an ordinance based directive that requires owners of pit bull dogs to maintain the animals within a six foot fence.

Specifically, the fence must meet the following requirements:

  • The fence must be six feet tall, measured from the ground.
  • The fence must be constructed of wooden planks at least ½ inch thick or 11 gage chain link fencing.
  • There may be no gaps or openings larger than 2 inches.
  • Fencing must be firmly attached to brace posts buried no less than 18 inches deep.
  • All gates must have a locking mechanism that keeps the gates securely closed.

These directive requirements become effective August 1, 2010.

Pit bull dog owners are exempt from the aforementioned requirements if their dogs are properly registered prior to August 1, 2010 and if they maintain compliance with all applicable Animal Service Ordinances such as the display of city tags and not allowing the dogs to run at large. Pit bull dogs not registered prior to August 1, 2010 must be maintained within an enclosure that meets these requirements. Owners who obtain pit bull dogs after August 1st must consider the cost of fence construction as a cost of owning a pit bull dog.

The proposed ordinance is certainly breed-specific regulation, and may become a ban. The proposal would affect the following: “German shepherds, Doberman pinschers, Rottweilers, boxers, Akitas, chow chows and any of the four breeds that fall under the pit bull umbrella.”
