Denver, CO: First reading on service dog exemption to ban, Oct 25

ADA ruling could alter Denver pit bull ban

by: Charmaine Robledo/YourHub.com
Article Contributed on: 9/29/2010 10:14:00 AM

The ADA ruling trumps breed-specific ordinances in cities such as Denver and Aurora. Denver first banned pit bulls in 1989 after reported attacks and reinstated the legislation in 2005.

With the ADA ruling in place, City Councilwoman Carla Madison now hopes council could make further exemptions for residents who comply with certain criteria, proving their dogs are well-behaved.

An ordinance placing heavy restrictions on dangerous dogs in the City of Sheboygan, including confining them to a stockade-style fenced yard when outdoors, forcing their owners to carry $300,000 in liability insurance in case their dog attacks and injures another person, and enforcing strict leash and muzzle requirements, was unanimously passed Wednesday by the Common Council’s Public Protection and Safety Committee.

The ordinance, introduced by Ald. Scott Versey, also would require owners of dangerous dogs to place warning signs on their premises, and ban anyone under the age of 18 from controlling the dog with a leash.

Ogden revisits pit bull restriction ordinance proposal

FOX 13 News
11:18 PM MDT, September 28, 2010

OGDEN, Utah – The city of Ogden is revisiting a proposal regarding pit bull dog ownership restrictions that were scrapped last year after a major public outcry. The proposal is back and was the center of a discussion at a city council meeting Tuesday evening.

Council members said the meeting was all about fact finding. But the city council already has drafted a ordinance outline called the “Dangerous Dog” ordinance, that would place restrictions on the ownership of pit bulls. The restrictions and regulations that some pit bull owners say simply are not fair. The Best Friends Animal Society calls it discrimination.

City approves animal ordinance

TIM HRENCHIR/THE CAPITAL-JOURNAL
Created September 28, 2010 at 9:58pm

Mayor Bill Bunten and eight city council members voted 9-0, with Councilman John Alcala being absent because of back problems, to pass a 39-page ordinance amending rules regarding animal control and animal cruelty to enhance public safety, protect animals and save taxpayer dollars.

The ordinance does away with the city’s breed-specific rules requiring owners to obtain special licenses and to implant microchips in any dogs that have the appearance and characteristics of being predominantly of any of three types of pit bull dog.

Tiffin, OH: Council to consider dog law

Although Tiffin’s proposed ordinance does not name specific breeds, Ohio State Law automatically puts all “pit bulls” into the “vicious dog” category. Therefore, any requirements Tiffin institutes for vicious dogs will also automatically apply to “pit bulls.”

The only way to allow Ohio cities and counties to pass truly breed-neutral laws is to pass the bill sitting in state legislature, HB 55, which would drop pit bulls from the vicious dog category.

Bermuda: Proposal to move some breeds from “banned” to new “restricted” class

The following 23 breeds are currently banned in Bermuda:

  • Akita
  • American Bulldog
  • American Pitbull terrier
  • American Staffordshire Terrier
  • Argentine mastiff (Dogo Argentino)
  • Aryan Molossus
  • Australian Dingo
  • Boerboel
  • Brazilian mastiff (Fila Brasileiro)
  • Bull Terrier & Miniature Bull Terrier
  • Bullmastiff
  • Cane Corso
  • Danish Broholmer
  • Dogue de Bordeaux
  • English Staffordshire Bull Terrier
  • Japanese Tosa (Tosa Inu)
  • Mastiff
  • Neopolitan Mastiff
  • Perro de Presa Canario
  • Perro de Presa Mallorquin
  • Rottweiler
  • Tibetan Mastiff
  • Wolf & Wolf Hybrid
  • All types of crossbreeds of the above mentioned dogs
  • This list of breeds cannot be considered as exhaustive. Any exotic or uncommon breed may also be refused entry despite its absence from the list above. The list will be amended as necessary.

The proposal would move some of these breeds into a new “restricted” category, which would allow the dogs in Bermuda, but with special requirements for owners. The article below contradicts itself; I cannot confirm at this time which breeds will remain banned and which are proposed to become restricted.

Bid to remove dogs from BDA’s banned breed list

Simon Jones

An overhaul of the way dogs are classified in Bermuda could be implemented within weeks. The move could see rottweilers, Staffordshire bull terriers and mastiffs taken off the banned breed list and put into a new “restricted” category. German shepherds, dobermans and Rhodesian ridgebacks would be placed into the same group. Dogs in the new category would be allowed into Bermuda but there will be additional conditions attached for keeping, licensing and breeding.

Ypsilanti Township, MI: Breed-specific MSN proposed

Remember, breed-specific mandatory spay/neuter is breed-specific legislation. It carries all the same flaws and moral dilemmas as any other type of breed-specific law. It is difficult to enforce, does not improve public safety, and results in the needless death of pets.

And, once you allow a municipality to identify a “pit bull” for mandatory spay/neuter (something which cannot actually be done in a fair or scientific manner), that municipality has the ability to identify a “pit bull” for additional restrictions. One resident makes a telling statement: “We’re not saying get rid of them, yet. And that’s another ordinance that could come up.”

YPSILANTI TWP: Officials may require spaying, neutering of pit bulls

Ypsilanti Township is considering a change to their code of ordinances that would require all pit bulls to be spayed or neutered by Jan. 1, 2011.

According to the language of the new law, pit bull owners found in violation of the ordinance would be guilty of a criminal misdemeanor punishable by not more than a $500 fine and/or imprisonment for not more than 90 days.
